{"id":1007,"date":"2008-08-25T01:00:37","date_gmt":"2008-08-25T05:00:37","guid":{"rendered":"http:\/\/www.filmbuffonline.com\/FBOLNewsreel\/wordpress\/?p=1007"},"modified":"2021-07-15T19:20:02","modified_gmt":"2021-07-15T23:20:02","slug":"disney-copyright-snafu-is-mickey-mouse-public-domain","status":"publish","type":"post","link":"https:\/\/www.filmbuffonline.com\/FBOLNewsreel\/wordpress\/2008\/08\/25\/disney-copyright-snafu-is-mickey-mouse-public-domain\/","title":{"rendered":"Disney Copyright Snafu- Is Mickey Mouse Public Domain?"},"content":{"rendered":"<p>I have to admit that there&#8217;s a certain iron to this that is quite delicious.<\/p>\n<p>After spending years and sacks of money to lobby Congress to continually extend copyright timielimits to protect their greatest asset, Mickey Mouse, the Walt Disney Company may not even have a legal copyright claim to the animated short film that launched the beloved character&#8217;s career.<\/p>\n<p>An article in yesterday&#8217;s <em><a href=\"https:\/\/web.archive.org\/web\/20181130180306\/http:\/\/articles.latimes.com\/2008\/aug\/22\/business\/fi-mickey22\" target=\"_blank\" rel=\"noopener noreferrer\">LA Times<\/a><\/em>, outlines the details of how Walt Disney may have not properly noted the needed copyright information on the 1928 cartoon&#8217;s title card. As per the Copyright Act of 1909, the law in force at the time of the animated short&#8217;s release, the word copyright\u00a0on a work needed\u00a0to be\u00a0&#8220;accompanied by the name of the copyright proprietor.&#8221; However, an examination of the cartoon&#8217;s title card shows three names listed above the copyright, leading some legal scholars to conclude that a reasonable arguement could be made that any of those names could claim the copyright. With Disney&#8217;s name actually being the furthest away, their claim could be considered the weakest.<\/p>\n<p>The article goes into greater detail on how this loophole was discovered, about how this has become a bit of a debate\u00a0in legal academic circles since the late 1990s\u00a0and how Disney lawyers really aren&#8217;t happy that it is being discussed at all.<\/p>\n<p>Additionally, Jerry Beck over at <a href=\"http:\/\/web.archive.org\/web\/20090129114435\/http:\/\/www.cartoonbrew.com:80\/disney\/la-times-on-disneys-mickey-mouse-copyright.html\" target=\"_blank\" rel=\"noopener noreferrer\">Cartoon Brew<\/a> points us to two of the scholarly papers discussed in the <em>Times<\/em> article- by\u00a0Lauren Vanpelt and <a href=\"https:\/\/web.archive.org\/web\/20160807035701\/http:\/\/homepages.law.asu.edu:80\/~dkarjala\/opposingcopyrightextension\/publicdomain\/HedenkampFreeMickeyMouseVaSp&amp;E(2003).htm\" target=\"_blank\" rel=\"noopener noreferrer\">Douglas Hedenkamp<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<div class=\"mh-excerpt\">I have to admit that there&#8217;s a certain iron to this that is quite delicious.
